Our Experience:

Thanks to the Farm Bill of 2018, industrial hemp has been legalized on a federal level. That means that its derivative cannabidiol (CBD), is legal to be shipped. That said, the situation is complicated by the FDA, which currently forbids the interstate sale of CBD dietary supplements. While Congress legalized the general sale of CBD, it made a distinct exception for products regulated by the FDA, such as food and dietary supplements. That said, products including CBD are widely sold even in states that are attempting to crack down on CBD edibles, such as New York and Maine. That said, there are other states that permit the sale of CBD products for consumption. California allows CBD products made from marijuana to be sold at licensed dispensaries, but not CBD products made from industrial hemp. The legal minefield of selling and shipping CBD products while abiding by federal, state, and local laws and regulations can be a challenge. One thing that is undisputed is the legality of shipping CBD oil across the United States via mail, with the provision that it is hemp-derived and not marijuana-derived. The concentration of THC levels must also be less than 0.3%. The forbidden compound tetrahydrocannabinol, also known as THC, is the main psychoactive ingredient of marijuana. The following states and districts permit the sale of CBD in edible form (at the time of writing):

  • Alaska
  • California (only CBD derived from regulated marijuana, not unregulated hemp)
  • Colorado
  • Michigan
  • Nevada
  • Oregon

  • Washington
  • Washington, DC

Additionally, the FDA has given legal protection to products that only contain hempseed oil, hulled hempseeds, or hempseed protein, as they have negligible CBD content and are designated ‘Generally Recognized As Safe’. An exception is also made for hemp that is higher in THC content than is otherwise permitted: it can be shipped for use as farm feed for cattle and other livestock. In general, unfortunately, the FDA has been caught flat-footed on the cannabis and CBD front, and are dragging their feet about coming to suitable regulations for products containing CBD. Luckily, the FDA does not, and cannot, claim jurisdiction over CBD edibles that are made and sold in-state, as its authority over foodstuffs is based on Congress’ authority to regulate interstate commerce. Useful to know if your hemp-derived CBD supplements are produced and shipped exclusively to locations in, for example, Florida.

CBD Warehousing and Fulfillment

When you’re storing CBD-based products for retail and later consumption, you need a sophisticated warehousing facility with higher standards of cleanliness than the average warehouse. Systems to facilitate inventory management protocols and track product locations in the event of a product recall will also make your operation significantly more efficient. A professional third party logistics provider (3PL) can be an excellent partner in this endeavor: instead of having to find, rent, and staff a facility of suitable size and sophistication for the necessary work, you can simply pay a 3PL company and outsource storage and order fulfillment.

After the Farm Bill of 2014, it is illegal for states and federally recognized tribes to restrict the interstate transport of legally grown hemp. In spite of this advance, shipping concerns are sluggish on the update. Only some national parcel carriers are willing to ship hemp products, including CBD oil. FedEx will not ship CBD at all, nor will it ship hemp oil, hempseed oil, or any plants or parts of plants. The US Postal Service, DHL, and UPS will ship CBD products with a THC concentration of less than 0.3%, so long as shippers are compliant with federal, state, and local laws, including those governing production, processing, distribution, and sales.

Shippers must also be able to show compliance documentation indicating they have complied with said laws for at least two years. DHL requires that any hemp shipments they take be sent in packaging that does not reveal what is inside. Meanwhile UPS will not take shipments of hemp-based products from marijuana vendors, nor will it ship hemp plants. Given the mutable regulatory status of CBD products, it is advisable to choose to work with a third party logistics provider that has past experience of storing and shipping them. In particular, if your provider can handle additional services such as product kitting and packaging, it will be easier to adjust product packaging or labeling if required by a new state or federal law, as they can do it for you instead of having to ship it back to you.

Is it currently legal for CBD distribution companies to ship CBD oil or industrial hemp products to every state?

Yes. However any CBD product you ship must be derived from hemp rather than marijuana, and as such it must contain less than 0.3% THC. Anything more than that makes it marijuana.

This is all still true – with one very positive twist. It’s now easier for CBD distribution companies to ship CBD and industrial hemp nationally thanks to a new USDA interim rule that was issued in late 2019.

Do all of the national U.S. parcel carriers (DHL, Fed Ex, UPS and the USPS) ship CBD and other hemp products?

All do, but only UPS, DHL and the U.S. Postal Service actually do. Fed Ex will not.

You’re in luck. All four of the national U.S. parcel carriers – including Fed Ex – will now ship CBD products. This is great news for shippers who want to choose from the widest possible range of reliable and economical parcel shipping options.

Are there any special requirements for shipping CBD oil and other hemp products?

The parcel carriers who accept CBD shipments have three primary requirements:

  • All products shipped must contain less than 0.3% THC level .
  • Shippers must ensure they’re compliant with all federal, state, and local laws that pertain to the manufacturing, distribution, sales, and transportation of hemp.
  • Shippers must maintain documentation that shows they’re compliant with the above laws for two years.

All of those requirements still apply, and there have been no significant new requirements added. That said, some states like Florida, have introduced more stringent labeling requirements, which means that orders shipped there may need a bit of additional attention in the warehouse before they can be shipped.

It’s also important to note that UPS will not ship any CDB or other hemp products that come from a location that sells marijuana or marijuana products, so bear that in mind as you’re choosing a CBD distribution company.

There have been stories about the seizure of packages or truckloads containing hemp in some state. Is that still an issue?

Although the 2018 Farm Bill permits the use of industrial hemp nationwide, it doesn’t supersede any state or local laws that pertain to the same subject. Much like some local municipalities have laws prohibiting the sale of alcohol, some states still can (and do) choose to exercise strong restrictions against the sale or transportation of hemp within their borders.

States and cities can still restrict the sale or production of hemp-based products within their borders. But per a late 2019 USDA ruling they can’t do the same with transportation. To quote that ruling: “States and Indian tribes may not prevent the movement of hemp through their states or territories . . . .”

Even so, it is still within states’ legal rights to make life tougher on hemp shippers by requiring costly transportation licenses or permits.

It’s something to keep in mind as you choose the most optimal and economical locations for your CBD fulfillment centers – and the best shipping routes for your incoming hemp-based products.

Do CBD oils and other hemp products require special material handling, parcel handling, or fulfillment protocols and are these subject to change?

It depends on whether or not the CBD or hemp product you’re selling is edible. If so, it’s a food-grade product that needs to be stored at a food-grade warehousing facility.

It also depends on whether your product has a sell-by or best-by date, because that will make efficient inventory control and picking procedures like first in/first out considerably more important.

Traceability is also key, especially if your CBD product is certified organic and your company strives to stay compliant with farm-to-shipping documentation requirements.

Per the latest word from the FDA, selling and shipping edible CBD products isn’t permitted. So our first piece of advice is moot, at least for now.

Meanwhile, sound inventory rotation and lot control processes are as important as ever, both in terms of preserving CBD products’ efficacy and ensuring product traceability (which is also important in the event of a recall.)

And yes, all of these protocols are subject to change – because this is, after all, the CBD industry.

Are there any other CBD distribution, fulfillment and shipping best practices you’d recommend?

As a general rule, we recommend that companies consider adopting some of the smart practices that are often used for the shipping of high-value products – including use of generic packaging that doesn’t advertise what’s actually inside packages, using tamper-proof packaging materials, and working with providers whose employees have been carefully screened and background checked.

It also might be smart to consider housing your product with a third-party logistics provider (3PL) or CBD distribution company that can provide value-added services like kitting and packaging. That way if federal, state or local authorities require you to make a modification to your product packaging or labeling, these 3PL employees can switch your packaging out in the warehouse rather than having to ship it back to you so you can do the same.

All of this still advice still applies – and some of it has already come in handy for some of our CBD clients, who are now being tasked with affixing different labels for packages that are being shipped to Florida. Amware is now handling the application of those labels in its facility.

Some hemp-based products, like CDB oil, also come in breakable containers, so using best dunnage and packaging practices – like tightly packing boxes with paper pods that are made out of craft paper (which can absorb the oil on the off chance that a bottle breaks in transit) – is also highly recommended.

2: Develop a Better Understanding of State and Federal Laws

Since the 1970s, cannabis has been classified as a Schedule I substance by the U.S. government. Although the Farm Act of 2014 differentiates hemp grown on the industrial level, there are still some states that don’t allow its cultivation even though importing it is legal in most forms.

Federal authorities consider CBD illegal if it contains 0.3 percent (or more) THC content. CBD oil extracts have THC content under 0.3 percent, which is why you’d most likely start your business selling CBD oil derived from industrial hemp.

3: Figure Out How to Acquire CBD Products

Of course, it helps if you’re able to prove that you’re a serious applicant. Getting all of the paperwork (including statements, taxes, and licenses) in order is a good start. Once that’s taken care of, focus on handling your accounts and keeping your books ready for evaluation at all times. An inventory management system can help you keep things in order.

Some businesses provide specialized payment processing for CBD sellers. However, you need to make sure they offer what you’re looking for before you enlist their services. A little research will go a long way in helping you solidify payment processing.

5: Enlist a 3PL to Manage Order Fulfillment

E-commerce order fulfillment comes down to three main options namely in-house fulfillment, dropshipping, and partnering with a 3PL service provider.

In-house Fulfillment

There are many CBD businesses that complete orders on their own. Some store their stock at home and use the local postal service to deliver customer orders. Others store their inventory at local warehouses and use the space and infrastructure to fulfill customer orders.

This method works effectively for people who are just starting out selling CBD goods and aren’t worried about handling large orders. As the demand for your products increases though, you’ll likely have to look for better alternatives to meet your growing needs.


Dropshipping involves both procuring products and shipping customer orders. In other words, you only market the products online without actually dealing with inventory yourself.
